Claims Against Unidentified Or Underinsured Drivers

If you have been injured in a motor vehicle accident and the at-fault party is not insured or is under-insured, you may still be fully compensated for your losses.

Under the Alberta Motor Vehicle Accident Claims Fund, if the at-fault party is not insured, the provincial government will cover your injury damages, provided the accident took place in Alberta. However, you must notify the authorities of your intended claim within the given time period. A Braithwaite Boyle lawyer can help you comply with the statutory requirements. The maximum amount payable for all claims arising from a single accident is two hundred thousand dollars. For multiple claims exceeding this limit, each claimant is paid in proportion to his or her claim to his injury accident total claim payable.

If the at-fault party's insurance or the money from the fund is not sufficient to fully cover your damages, you may be able to make up the difference from your own automobile insurance company if your policy includes optional SEF 44 coverage. An SEF 44 endorsement provides third-party coverage to whatever limit you have specified in your own third party motor vehicle insurance policy. If you are not sure whether or not you have an SEF 44 endorsement, contact a Braithwaite Boyle lawyer for a free consultation.
