CLAIMS AGAINST UNINSURED OR UNIDENTIFIED DRIVERS

If you have been injured in a motor vehicle accident and the at-fault party is not insured or is under-insured, you may still be fully compensated for your losses.

Under the Alberta Motor Vehicle Accident Claims Fund, if the at-fault party is not insured, the provincial government will cover your injury damages, provided the accident took place in Alberta. However, you must notify the authorities of your intended claim within the given time period. A Braithwaite Boyle lawyer can help you comply with the statutory requirements. The maximum amount payable for all claims arising from a single accident is two hundred thousand dollars. For multiple claims exceeding this limit, each claimant is paid in proportion to his or her claim to his injury accident total claim payable.

If the at-fault party’s insurance or the money from the fund is not sufficient to fully cover your damages, you may be able to make up the difference from your own automobile insurance company if your policy includes optional SEF 44 coverage. An SEF 44 endorsement provides third-party coverage to whatever limit you have specified in your own third party motor vehicle insurance policy. ​CLAIMS AGAINST OWN INSURER

If you are involved in a motor vehicle accident, in most cases, your own insurance company has the responsibility of repairing your car. If you are injured and cannot work, they have the responsibility of paying your Section B Benefits of up to $400.00 per week for as long as you cannot work because of your injuries.

If, for some reason your insurer refuses to pay these or other responsibilities that they have to you, you will be required to sue them in order to obtain the full and proper benefits to which you are entitled under your insurance policy.

If you are required to sue your insurer, you should retain a lawyer to assist and advise you. If you bring a lawsuit, legal counsel will represent the insurer and therefore, you should also be represented. The limitation periods for suing an insurer are much shorter than for a regular civil lawsuit and therefore steps need to be taken much more quickly.
