PIONEER IN INJURY LAW

I want to make sure that every seriously injured victim has the resources to recover like I did.  That’s why our lawyers have redoubled their efforts to ensure that every seriously injured accident victim has access to extensive medical treatment and legal guidance without any upfront litigation expense to them."  Ken Braithwaite
Braithwaite Boyle actually pioneered this approach to helping accident injury victims back in the 1980’s.  “We were the first law firm in Alberta, or possibly Western Canada, to require no payment upfront from our clients.  Not only do we defer our legal fees, we also pay for the additional medical tests, expert and engineering reports required to get the insurance companies to pay the proper compensation” stated Ken Braithwaite.

Many new law firms have since copied this model of deferring legal fees, however many still do not offer the level of support to accident victims that Ken Braithwaite has committed his firm to providing.

A TRUE team approach is what you will get at Braithwaite Boyle however.  “We understand the benefits of specialization.” remarked Ken “Not only is our law firm exclusively dedicated to personal injury law, we also truly work as a team.  Our lawyers consult each other on every injury file and clients directly benefit from that kind of collaboration.  Most of our lawyers have stuck with our firm for over 10 years, and a few have even been with us for over 30+ years, so we know the strengths that each lawyer brings to the table.  And we leverage those strengths when it comes to getting our clients just and fair compensation for their injuries and income loss.”

Another thing that separates Braithwaite Boyle from other law firms is their commitment to the ethical practice of law.  “The most important thing to consider when choosing a lawyer is your level of trust”, stated Ken.  “That is why I will never understand law firms that exaggerate their experience and “results”.  Some even tout their “leading settlements” without fully disclosing important details like the fact that it took over a decade to settle the case.  At Braithwaite Boyle we understand that most injured victims can’t afford to wait a decade to receive payment for their accident injuries. We work hard to ensure they receive the maximum level of compensation they are entitled to.”

If you, or a loved one, has been seriously injured in an accident remember to ask these important questions before hiring a personal injury lawyer.

FREQUENTLY ASKED QUESTIONS (FAQ)

Why should I hire a personal injury lawyer rather than settle my injury claim myself?
In a study conducted on behalf of an insurance association, it was determined that on average those represented by legal counsel received 3.5X more than those who settled their claims without legal advice*.  Even when you factor in the contingency fee charged after your case settles, you will still likely end up with more than what you could negotiate on your own.  You have nothing to lose, and a whole lot to gain being represented by a lawyer.

How do lawyers get more compensation for accident victims?
You generally receive a higher payout because you deserve more than what insurance companies will voluntarily pay.  Accident victims are often not well versed on how much their claim is worth.  We are.  Insurance companies will often take advantage of your lack of knowledge, and their superior bargaining position, to pay you less than they have to.  In some instances, insurance companies can even avoid paying at all.  The decision to act on your own could potentially cost you hundreds of thousands of dollars if you have very serious injuries.  This can leave you with without the necessary financial support to treat life long pain and suffering.
Can’t I at least try to negotiate my own settlement, and then use an injury lawyer if it doesn’t go well?
This is the most common mistake that injured parties make.  The sooner you call us, the more we can help.  We often hear from people whose claim is approaching its deadline.  While we try our best to preserve their rights under the law, they have often disclosed so much information to the at-fault party’s insurance company/adjuster that they have put themselves in a very poor position of recovering fair and just compensation.  Sometimes there is just not enough time to file the necessary paper work with the court and the accident victim loses their right to pursue a claim entirely.
When should I contact a lawyer after being injured in a car accident or by someone else’s negligence?
Call us immediately after seeking medical attention.  Do not talk to anyone else - other than your doctor and the police (in your police report)
What if the person who hurt me doesn’t have insurance?
Fortunately in Alberta the government maintains a fund to compensate victims for their injuries in those circumstances.  It can get complicated however, and it’s best to have one of our lawyers acting for you in that circumstance.
What if I am partially responsible for my injuries?
You may be mistaken about your liability under the law.  Even if you are held partially at-fault, you may still be entitled to substantial compensation.  Call Braithwaite Boyle injury lawyers immediately to protect your rights.  There are many ways we can help you recover compensation for your injuries as long as you don’t wait too long.
But I don’t want to cause trouble for the person who injured me.
Most people are covered by insurance whether they realize it or not.  Even when insurance is not available, the government maintains a fund to compensate injury victims. If you still feel bad after you have been fairly compensated, you have the choice of directly compensating anyone you wish.  Leave your options open.
When should I NOT pursue an injury claim?
Do not start a claim if you are unwilling to follow your doctor’s instructions and see it through to the end.  Claims involving serious injuries often take years to resolve, and you should never agree to a settlement before you have fully healed as you will not know the full extent of compensation you are entitled to.
